5.3 Additional Local Advertising. Subject to the prior written consent of the franchisee, the franchisee shall, at the franchisee`s expense, make additional advertisements in the franchisee`s entourage and the franchisor may offer the franchisee, from time to time, authorized local marketing plans and materials, including, but not limited to, advertising models covering advertising before and after the opening, under the same conditions; which the franchisee then offers to his other franchised fitness center. Prior to use by the franchisee, samples of any local marketing materials that have not been prepared or previously approved by the franchisee must be subject to the written permission of the franchisee, whose permission cannot be inappropriately withheld. Notwithstanding the generality of the foregoing, the franchisee devotes three (3%) of gross revenue per month to local advertising in its marketing sector. . . .
